McHenry County Charities Beneficiaries of Settlement Fund

MCCULLOM LAKE, Ill.--([ BUSINESS WIRE ])--Layser & Freiwald, a Philadelphia law firm, and Modine Manufacturing Company (NYSE: MOD), a diversified global leader in thermal management technology and solutions with a manufacturing plant in Ringwood, IL, jointly announced today that more than $815,000.00 would be distributed to charities in McHenry County.

The money is what remains of a fund established when Modine and a group of McCullom Lake residents settled Modinea™s portion of a case involving Modine and its neighbor, Rohm & Haas in 2008. As part of that settlement, a $1.4 Million fund was established to reimburse the costs of medical monitoring. The time allowed for such medical monitoring has expired, leaving more than $815,000.00 in the fund.

The attorney for the plaintiffs in the case, Aaron J. Freiwald, worked with Modine to identify local charities to receive the remaining monies. The parties made a joint proposal to United States District Judge Gene E.K. Pratter in Philadelphia, as to the charities and the amounts to be received by each charity.

Yesterday, Judge Pratter ordered that Gavers Community Cancer Foundation, Johnsburg Education Partnership Foundation Inc., McHenry County Community Foundation, McHenry High School District 156 Foundation Inc., and Neighbors Helping Neighbors Charity, NFP receive the monies.

Under the judgea™s order, Gavers will receive at least 50%, exceeding $407,500; McHenry County Community Foundation will receive more than $163,000. The other three charities are eligible to receive more than $81,500 each, provided they meet certain requirements established by Judge Pratter regarding their charitable status. Any amounts that dona™t go to one of these three charities will be paid to Gavers.
