I-Flow Resolves Patent Infringement, Trade Secret Litigation against Apex Medical Technologies, Zone Medical

LAKE FOREST, Calif.--([ BUSINESS WIRE ])--I-Flow Corporation, a subsidiary of Kimberly-Clark Corporation (NYSE: KMB), is pleased to announce that it has reached an agreement resolving patent infringement and trade secret litigation against Apex Medical Technologies, Inc. and Zone Medical, LLC effective June 10, 2010.

Under the terms of the agreement, Apex and Zone will discontinue manufacturing and distribution of the Solace® pump, surrender to I-Flow various pump-related tooling, and pay I-Flow undisclosed compensation. Apex and Zone will be able to sell off up to 3,000 units of their remaining product inventory through Aug. 13, 2010, in the United States and the remaining inventory, an additional 3,000 units, in international markets until Nov. 11, 2010.

As a result of the agreement, the patent litigation against Apex and Zone will be resolved, and Solace® will cease to be manufactured and sold in the U.S. and international markets.
